Official Rules
Please read over these official rules (the “Rules”) carefully before entering the 50/50 Raffle (“the Raffle”) benefiting Tulsa Area United Way, a 501(c)(3) non-profit charitable organization (“TAUW”). By participating in the Raffle, each participant (“Entrant”) agrees to be bound by the Rules and by the decisions of TAUW. The Raffle is conducted pursuant to Oklahoma law, and is void outside of Oklahoma.
Eligibility
Except as otherwise provided herein, and subject to these Rules, the Raffle is open to persons who are age eighteen (18) or older as of the date of entry. Employees of TAUW and their immediate families (spouses, siblings, parents, children, and household members) are not eligible to participate in the Raffle.
How to Enter
While supplies last, Raffle tickets (“Tickets”) will be available to purchase online at www.tauw.org or in person at 1430 S. Boulder Avenue, Tulsa, OK, 74119 from December 5, 2023 to December 15, 2023 at 5:00 PM CST. Entrants may purchase one Ticket for a voluntary contribution of fifty dollars ($50). Entrants do not need to be present to win and must attach their name to each Ticket purchased. If purchased online, an authorized TAUW staff person will attach entrant name to entrant’s Ticket.
Drawing
A stub from every Ticket sold will be placed in a corresponding Ticket box. A random drawing under the supervision of an official of TAUW (the “Drawing”) will be made on December 19, 2023. The Entrant holding the winning Ticket (the “Potential Winner”) will be contacted by December 20, 2023, and the decision of TAUW to determine whether the Potential Winner is the official winner of the Prize (the “Official Winner”) is final.
Prize
Subject to these Rules, the Official Winner will be awarded 50% of the funds generated from the sale of Tickets, as determined by TAUW in its sole discretion (the “Prize”). The remaining 50% of proceeds from the Raffle will benefit TAUW. The Official Winner assumes all responsibility for any and all applicable state, county or federal taxes, fees or withholdings. The Official Winner must claim the Prize at 1430 S. Boulder Avenue, Tulsa, OK 74119 within thirty (30) days of the Drawing (the “Deadline”). If the Official Winner fails to claim the Prize by the Deadline, such Official Winner shall forfeit the Prize and, subject to these Rules, a new Official Winner will be chosen by random drawing among all remaining eligible entries; provided, however, if, after selection of three (3) Official Winners, the Prize has not been claimed within thirty (30) days of TAUW’s notice to the last of such Official Winners, the Prize shall be deemed forfeited and shall become the property of TAUW. The Prize will not be shipped. As a pre-condition to receiving the Prize, the Official Winner shall complete any and all forms and documents as may be required for federal tax reporting or withholding purposes in accordance with IRS regulations.
Odds
TAUW will sell up to a maximum of 198 total Raffle Tickets. The odds of winning will vary and will depend on the number of total tickets sold.
Publicity
Except where prohibited, participation in the Raffle constitutes Entrant’s consent to TAUW and its agents to use Entrant’s name, likeness, photograph, voice, or video for promotional purposes in any media in reference to the Raffle without further payment or consideration.
Release
By purchasing a Ticket, each Entrant agrees to release and hold harmless TAUW and its agents from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Raffle or receipt, use or misuse of any Prize.
Taxes and Deductibility
The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts and therefore do not qualify as deductible charitable contributions. The Official Winner may be issued an IRS Form W-2G for the value of the awarded Prize.
Disputes and Governing Law
The Raffle shall be governed by the laws of the State of Oklahoma. Any claims regarding the Raffle that are not released must be brought in the State or Federal Courts in Tulsa County, Oklahoma. IN NO EVENT SHALL TAUW OR ANY RELATED ENTITY BE LIABLE FOR DAMAGES THAT EXCEED THE VALUE OF THE PRIZE AWARDED TO ANY ENTRANT IN THE RAFFLE.
